Die Verfasserin berichtet, dass der Gerichtshof der Verfassungsbeschwerde einer behinderten Werkstattbeschäftigten stattgegeben hat, die sich gegen die Einstellung des Strafverfahrens gegen ihren Werkstattleiter wegen sexueller Belästigung zur Wehr gesetzt hatte. Der Berl VerfGH sah die Beschwerdeführerin in ihrem Grundrecht auf effektiven Rechtsschutz nach Art. 15 Abs. 1 der Verfassung von Berlin (VvB) verletzt und verwies das Verfahren ans Kammergericht zurück mit der Aufforderung, dass weitere diskriminierungsfrei zu gestalten. Die Verfasserin erläutert, welche Maßgaben sich aus der Rechtsweggarantie des Art. 15 Abs. 4 Satz 1 VvB, dem Verbot der Geschlechterdiskriminierung, dem Verbot der Diskriminierung wegen der Behinderung und Art. 13 Abs. 1 des Übereinkommens der Vereinten Nationen über die Rechte von Menschen mit Behinderungen (UN-BRK) ergeben. Zinsmeister erläutert die verfahrensbezogenen Bedarfe behinderter Menschen und die Nachteile, die ihnen im Strafverfahren drohen und zeigt notwendige Maßnahmen auf, um verletzten Zeug*innen mit Behinderung in sämtlichen Phasen des Strafverfahrens einen gleichberechtigten Zugang zum Gerichtsverfahren zu sichern.",
